VLCT’s Water Resources Program has updated guidance on drainage management best management practices and sample standards for town highway access policies to reflect the finalized VTDEC Municipal Roads General Permit issued earlier this year. These standards may be used to customize the MAC Model Town Highway Access Policy and help municipalities formalize the access permit process.
MAC’s attorneys can help towns by providing legal review of highway access policies and forms for compliance with state law. Additionally, with the onset of the MRGP, it is particularly important for towns to review their highway access regulations – which may be through policies, ordinances, zoning bylaws, or specifications – to see whether drainage into the public right-of-way is addressed. VLCT Water Resources Coordinator is available to assist individual towns with this review.
