If you receive a petition by 5pm today (Thursday January, 15), and it must be returned for failing to conform, please be aware that the following extension may apply to the filing of supplementary petitions.
As noted in our municipal calendar, Sunday, January 18 is the last day for filing supplementary petitions after the original was found not to conform. 17 V.S.A. § 2642(a)(3)(B). However, if the 48 hours to submit a supplemental petition falls on either Saturday, January 17 or Sunday, January 18, the deadline to file is automatically extended to the next day that is not a Saturday, Sunday, or legal holiday. Because Monday, January 19 is Martin Luther King Jr. Day (a legal holiday under both State and federal law), the deadline to file a supplemental petition in these instances will be Tuesday, January 20. 17 V.S.A. § 2103(13). Again, please note that this extension will only apply if the 48 hours to file the supplementary petition falls on either Saturday, January 17 or Sunday, January 18.
